Hi Guys, just after a bit of a heads up on eBay rules before a potential incident happens.
There was an item on eBay last week which had a reserve price and a BIN price. The seller had stated in his description what the reserve price was. All good so far. My highest bid was a fair bit below what he wanted. Anyway, I got an email from the guy saying he has dropped his reserve price. But it was still higher than my maximum bid. I mailed him back offering to up my bid to his reserve if he would sell it for that price posted. He replied saying no, that was his final price. Fair enough, no hard feelings. Anyway, the auction came to an end with me as the highest bidder, but below his reserve price. So that means I don't win it. Still all good so far. Anyway, correspondence has been passed since the end of the auction and he is adamant he will not accept my offer. The usual "I'm not fussed if it doesn't sell, I'll keep it" response was forthcoming but in a not so polite manner. Anyway, after it didn't sell, he relisted it. It got a couple of bids, so I thought I'll bid on it again, but this time my maximum was not as high as I had before. I am currently the highest bidder, but here's where the catch is. It looks as if he's forgotten to put a reserve price on it. So what's the score now? If come the end of the auction, I am still the highest bidder, am I entitled to it even though he wanted a lot more for it? He may realise he hasn't put a reserve on it before the end and pull the plug on it, but if he doesn't and the auction ends as me the winner, what rights do I have to claim it? I guess he could turn round and say the goods got damaged and are broken and offer me a refund. What do you think?

If there is no reserve then at the end of the auction the item is yours mate! if he pulls it then you're stuffed but i don't think you can pull an item within 24 hours of the end??

unless its something you know you wont see again i'd let it run and see what happens,if you dont win it just put it behind you and keep on looking :daumenhoch:
if you really want it and you win it, pay via paypal and keep all correspondence, ask to pay the extra for recorded/registered delivery , if he get funny about it force the payment through paypal and you've done everything on your side,
this way if it does go to a non-receipt claim and if he leaves you negative feedback e-bay will remove it and pay-pal will reimbuse your payment,
and if he's rude with them or hasnt got his facts straight they'll be rid of him.
its a lot of titting about though mate, if he's aggressive or rude in the first messages i'd leave him well alone :daumenhoch:

that about sums it up, if the seller forgot to put a reserve on it it's his lookout, he is legally binded to sell you the item if you win it, albeit for a lower price than he expected.....
I nearly always get stuff send recorded, and in fact send stuff recorded, it only costs about 80 pence extra for piece of mind :)

I don't think he will realise until the end that he hasn't put a reserve on. if there are already bids on it, can he then stick a reserve on afterwards?
i'm sure if i do win it at the price i've bid, there's no way he will let me have it.

ONCE THERE ARE BIDS ON AN ITEM IT CAN'T BE CHANGED, PRICE-WISE OR (OOPS, CAPS-LOCK ON!!), the original text etc (that's better), only additional info/pics can be added.
If you win, pay on-time, and ask for Special Delivery or Recorded, or possibly collect or get one of us to collect it for you ??? Is the seller near you ?
If the seller has good feedback i am sure it'll be okay

the guy has a 182 feedback rating with 98.9% positive.
unfortunately the seller is about 250 miles away in the north west.

ok, i've only just won this item now for £104. some £50 less than last weeks offer and £76 less than what i know the guy wants for it. what should i do now? if i pay for it now via paypal. it could be a pain trying to get it back if he doesn't ship it. i know he could refund the money and i don't think it costs anything (i wish i knew this before the Ilegal raffle). but alternatively he could just pay me £104 in which case I lose out on paypal fees.
my thinking is to contact the guy now and ask him if he wants payment via paypal or cheque, that way he will know the money is coming and he can then stop me sending the money if he is not going to send me the item. i feel a negative coming on....

only if the refunder uses the refund option. i've had people who have refunded money to me before, but have sent it as a new payment, therefore been subject to paypal fees.

Exactly what I said, if they refund you there are no charges. Them sending you a payment is not really a refund.

well that's only if the bloke actually sends me it. that was the one you told me about though. got it second time round. if he does send me it, then i've got it nearly £150 cheaper than what he originally wanted for it...

i've just come back from the pub and have received a response from the seller. i had mailed him asking him if he prefered paypal or a cheque. i would have always paid by paypal but thought it would be a good way to contact the seller and make him aware of the price i had won his bike at. he has replied and said he would prefer paypal. although strange that his reply had come about six hours after i had actually paid him... so i guess he must have realised his mistake and resigned to the fact that my offer was gonna be the best he got. maybe a lesson learnt for him too. had he accepted my original offer he would have been about £50 better off, plus the relisting eBay fees he's had to pay.
