Some of you may remember a while a go I had some bikes stolen, one of them was this GT:-

Now yesterday I found out that it was sold in a Police Auction and a friend of a work colleague bought it for peanuts. I've informed the Police about this as I'm disgusted that this has happened. So far I've not had a call back from the investigating officer. Does anyone know where I stand?

I've asked my colleague to ask the buyer if he's willing to sell it back to me but he wont and it sounds like he's going to try to sell it for a mass profit on ebay. I can only hope the Police can do something about getting it back for me! hmmmm

I would def. consider some kind of legal action here Del.

or if it does turn up on ebay, win it, say you'll collect it, when you have the address send your local bobby round armed with the details you provided when it was stolen. it doesn't matter that they bought it from a police auction, legally that bike is still yours I'm sure.

Man, I'd be livid if that happened to me. Every bike apart from 1 I had as a kid was stolen and 3 motorbikes as an adult so I know how it feels. The old bill are useless with things like this. The fact that it was sold on at a Police auction just really doesn't surprise me. I hope you get it back mate as it looks a cracking little ride. As for the friend of a friend that has it now I'd give a local crack head a score to have his car wheels away and tell him he can buy them back at the next police auction too.

I mean, I know old GT's with black tuffs turn up all the time so it's easy for them not to realise that one was yours!

Winning it on Ebay and paying the new owner with policemen may be the most effective way of resolving this one.

there has to be a way of getting the gt back, it was stolen and the fact that the police sold it does'nt make it legitimate,

go to the bloke that has it and tell him he can either sell it to you for what he paid or he can lose his money when the police seize it.

I'd say, legal action because you certainly have a case! Contact local and national press because it's a major cock up on the bizzies behalf and the wouldn't like the negative coverage. Also, name and shame the fooker who knows he's got a someone else's bike that he intends to sell at a huge profit, any decent person who knew the rightful owner had been found would give it back - I would - @rse hole!

By the way, how did you get the photo of it at the new owners house?

We could always pay him a visit Del and apply a little pressure  :knuppel2: mate, no problem here if you want to do that, just give me a nudge.

Spot on, legally ownership has not been transferred as the bike is still yours.  You are entitiled to retrieve said goods from the person now in possession of the goods that person then has a claim against the Police.  I'd contact the Police and tell them you know where your "STOLEN" bike is and that you want them to go with you to recover the item as you are legally entitled to.

If not, then fook contacting the investigating officer, contact the Chief Constable explain that it is a collectable item worth a large sum of money and that if he doesn't get it sorted you will take it further - media or legal action.

I think I better make things a bit clearer....

The guy who bought it from the police auction is a friend of a collegue at work... I got the pic because it was a conversation that went a little like....
"hey look what my mate got the other day, you're into these BMXs right?"
"yeah I am and that's my fooking bike! where did he get it from?"

Now I can see that the guy who bought it thinks he bought it legitimately, but he now knows it was mine and was stolen but according to my colleague will not sell it back to me. All I can do at the moment is see what plod says (when/if they ever ring me back) and then take it further if nothing happens

You could try calling the plod again but talk to someone else, sort of by passing the guy you cant get hold of. Just say that you know where your stolen bike is, and can they send someone round. Dont say anything about where he got it from or that you know the whole story, just say that it IS your stolen bike.

Not a great plan but might be worth a try if it gets as far as it being on Ebay.

what a piss take mate,having your bike stolen......then the rozzers selling it on later....cant believe it!!

I say if we all paypal you a tenner then you should have enough funds to buy it back off ebay........although thats not the friggin point!!

Del, if the peelers say the bike no longer belongs to you, then get on to the media etc - just typical of the way law and order is (not) working in the UK at present.

That said I must congratulate the coppers down our way, when the missus and my cars were pilfered from they managed to call round get our statements in 24 hours and catch the twat in 48!!!!

Sorry to hear about your loss, but  this will make a big noise in the tabloids.

No wonder they are trying to get a payrise if they have to resort to selling stolen goods. What happens to the money from their jumble sale?

 :'( I had a £1500 S&M RV stolen a few years ago-out on it`s maiden ride,so I fully appreciate how it feels to lose such a great bike.Shows how bloody incompetant the police can be.Really hope that you get it back asap.The guy who has it now needs to wake up and do the right thing.

I was going to mention the Insurance payout situation as once paid out the item becomes property of the insurance company (not the Police!)

As that is not the case then the item is still yours and not only have the Police not done their job by not returning it to you (can you prove that you are the rightful owner?) then they indeed have broken the law by selling stolen goods!

I would march into the Police station and inform them that you would like to report aincedent of someone selling and someone receiving stolen goods......make it official and tell them that your Solicitor has been informed!

Its a tricky one going up against the Police but as someone else has mentioned contact the local pres and tell them the whole story especially if you have names and badge numbers!

Mate, that just goes to show what a f*ckin state this country is in.
Its the most f*ckin ridiculous story i have ever heard, infact im finding it truely fu*king unbelivable to take in, to the point where im starting to think that it is untrue, even though i dont think its untrue!!!!!!!. I woke up at 5.30a.m this morning to the sound of a lorry  rumbling outside the back off my house where i keep two of my work trucks. It was a bunch of " do as you likeys " breaking into the back of one of them. I phoned the police to tell them that  they were nickin something and i needed them to come over. They started to question whether or not this was actualy happening so i told them that iff they didnt come over i would go out there myself with half a scafold pole and sort the problem out myself, then they told me that they were on there way over to arrest me!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!!.

Anyone takes anything of mine will meet my friend P-A-I-N! I care not a jot about getting charged with assault, if they take mt stuff I will take their kneecaps and more, if they hurt my wife and children I will take MUCH more and they'd wish they'd never met me. I would inflict a level of pain on them that they think it physically impossible. I would quite happily go to court and tell them if it was to happen again I would do it again and if I got time I'd serve it happy in the knowledge that I'd confronted the people who wronged me or my family. If I didn't I couldn't look myself in the mirror!

Bloody Hell Del, I had no idea youd had bikes nicked - and then fund this one again! Thats totally and utterly out of order that the bloke who now has it wont consider selling it back to you. If I bought a bike that was then irrefutably a nicked one, Id never for a moment not consider either giving back or at tleast getting my money back and selling to the rightful owner. As for the police, they owe you big time mate, if its been logged as stolen, a case was opened, then they sold what they should have been 'looking' for, then they may owe you the small amount they got for it... but perhaps dont hold your breath.

Feck Del Iv just read all this, there are a few things you could do..
1 Win it on ebay then give the bill to the (useless cnuts) sorry Police
2 Inform ebay when it goes on there that it is your bike & so its stolen property
3 get hold of the Police & ask them what the feck they are playing at & what they are going to do to put it right
4 Go to the press, in fact do this anyway, this should help there claim for a pay rise

BTW Del, I would be happy to send you £10 to get your bike back.

Del, you need to get this sorted straight away with the police. Pester them four or fives times a day until you get an answer.  Get advice from the Citizen's Advice Bureau too.
I wouldn't go down the path of buying it on eBay then trying to claim your money back, as you'll probably lose out and it may cost you a small fortune. If it does reach eBay and to avoid it getting moved on to someone else, report it to eBay straightaway as the seller is selling stolen goods. That way eBay should pull it straightaway and at least you'll still know where it is.

If the legal way doesn't work, then send a few of the lads round to "collect it" for you.  At the end of the day, you can't get nicked for taking what is yours. This guy would have to claim against the Police to get his money back as it would be nothing to do with you.

Also a word of advice for everyone here. It would be a good idea to get pictures of all your rides. I know most of you do anyway, to show them on here. But if you could get also get yourself in the pics, then that is better proof that it is your property.

Im still just totally dumbfounded and havnt stoped thinking about this all day.
Del, dont ring the police, go down to your local police station and speak to an officer to explain exactly what has happened face to face. After you conversation make sure you get a crime refrence number and like other members of this website have said mention going to the papers. I just really cant get my head round the whole story, it is unbelivable. Im so shocked about what has happened to the point that if that bike dos'nt come back to you i am going to put some sort of pertition or document together myself to the police and make the story heard where it needs to be heard. Im furious about it and like i said if it dosnt come back we all need to throw our waight behind this 110%. Read what has happend, its f*cking bonkers. Im lost for words. THE POLICE ARE HANDELING STOLEN GOODS AND TRYING TO SELL THEM ON IN A POLICE RAFFEL.

Whats entirely more likely is that the bike was handed in as found property, never claimed, and subsequently auctioned off.

The problem being that the police's left and right hands are clearly not familiar with each other...

My problem with the whole thing is that the bloke who has it now is refusing to give it to its rightful owner. That stinks as far as I'm concerned. I almost expect the old bill to fcuk it up, but for someone to keep hold of something that he KNOWS belongs to somebody else; well its's just plain wrong in my book.

The rozzers are not getting away with it, I'm still going to make a formal complaint as soon as the bike is back in my hands... at least he's not trying to sell it on to someone else.

Its not just the roozers ! i bumped my bmw last year and the insurance took my car away and sold it without even agreeing a claim with me  ::) luckily a mate was at the auction and phoned me saying i think i've just seen your car being sold....................................anyways i managed to get it back in the end.....twats

im reading this and cant just get my head round it at all. i hope this guy does actually give u the bike back del . let us all know when he does mate. just goes to show u can take all the pics u want and log the frame number and even find the fooker urself . and the pigs still wont do their job and get it back for you. wtf.

i've just noticed the thread also, cant believe whats happend,

Glad you should be getting it back, but what about your other stuff ?
Maybe now try to find out how and where the police found it, as your other stuff may have been there also, maybe some of its still about?

del hope everything goes all right  but would still go the police before you get your bike back just to edge your bets, also cant see why he dont give it straight  back? ?  why do you have to wait a week (which is about the same time as a 7 day listing on the bay)  ???

Ade: Auction was in Farsley, I'll be keeping my eye out on that one!

Flaz: its not his fault I have to wait 'till next week, I could have gone for it this weekend but I've had plans this weekend so I said I'd make arrangments for early next week.

As soon as I make the complaint to the police I hope some light wil be shed on my other items but I dont hold out much hope.

Hello del.
Ive been so busy with work that ive only just got round to looking at this thread again and im so pleased your bike is coming back to you. All in all just a crazy story that highlights the utter state of the police force in the U.K.
I really hope you continue to press with what happened to you and persist in getting the answers you desserve to find out from them.
I would still consider going to one of the papers to tell this story, you can see from the tread what a massive amount of intrest this story has generated and maybe you will be able to recoupe some of the money you will undoubtedly be spending to have the bike returned to you.
Im extremely happy for you because your absolutly fantasic bike is coming home but still massivly pissed of that i pay vast ammounts of tax for a f*cking police force that delivers sh*t like this on top of all the other underachiving they produce. I honestly hope it will be easily explainable, but you know what, I doubt it will be.

Hi all,

well the GT is now back home with me, its rather wierd seeing it back here. I actually paid the guy what he paid for it at the auction (give or take a few quid). Now that I actually have the bike back its time to ruffle some feathers at the Police station, I hope to be poping over there tomorrow evening after work.

I'd just like to thank everyone for all the support/kind words and pm's I've had the past week. We've got a great community here and i feel honoured to be part of it.
 
Anyway its still not over and I'll keep you all in touch with what happens when I make the formal complaint.
