I won a set of Renthal bars from ebay user 'justcallmespidey' last weekend, his listing for them had no description of condition but he had posted a question he answered on the listing, replying that the bars were "mint, some scratches but will come out with wire wool"
Because of that reply on his listing i decided to have a punt & ended up winning them, expecting them to be as described.
link to listing: http://cgi.ebay.co.uk/ws/eBayISAPI.dll?ViewItem&rd=1&item=320244613645&ssPageName=STRK:MEWN:IT&ih=011
The bars turned up on Friday & when i opened the piss poor packaging they were sent in, the bars were in a complete state, far from being 'mint' they are covered in scratches, 80% of them being very deep. the allan bolt on the cross brace is badly chewed..I would describe them as good condition at best.. & just to put the icing on the cake, the guy charged me £12 postage & the package cost him £5 to send..
I decided to message the seller to inform him i was unhappy & try to resolve the issues...heres the messages i sent & the replies i got, its good for a giggle if nothing else :LolLolLolLol:
Dear justcallmespidey,
hi, i received the Renthal bars this afternoon & i must say i am very disappointed.
They are far from being in the "Mint some scratches but will come out with some wirewool" condition that you posted on the listing.
There are loads of scratches on the bars & most of them are deep which will definetly not come out with wire wool, they will need wet n drying to a fine grade & buffing on a polishing wheel to bring them anywhere near decent condition.
The black cross brace has a few small nicks too, plus one of the allen bolts is 80% chewed making it extremely difficult if not impossible to remove & replace.
I would say the bars are in good condition at best...
& just to top it all off i get charged £12 postage when it only cost you £5 to send the bars to me.
Could you please get back to me regarding these matters..
Many thanks
Dear djgivvinup,
Define the word mint , not in my listing but a reply to a question and as I would say so to for being of its age , alan bolt ? unaware so sorry , postage a I dont pre weigh items so there we go , would you like a refund ? not a problem refunds are not an option as not stated but in your case , refund item not postage costs , feedback if your unhappy leave negitive feedback its not a problem for me , your feedback will mirror mine . let me know what you want.
Dear justcallmespidey,
Hi, you posted that reply to a question on your listing so surely that means it WAS in your listing? The word 'mint' means the item should be in the same condition as it was when first made, brand new no marks or damage of any kind.
As you added the words "some scratches but will come out with some wire wool" i along with most people would assume the bars were in near new condition but with some light surface scratches, which they are clearly not.
With regards to the allan bolts, like i said one of them is badly chewed, if you are to reply to a question regarding condition & post it on your listing surely you would check the bars before blurting out that they are "mint"?
As for the postage, the fact is i have paid £7 more than the actual postage cost.
If a full refund is issued then it will be for the £59 i paid.
I contacted you assuming we could come to an ammicable resolution of this matter, not for threats about negative feedback.
Dear djgivvinup,
Well mint is a word up here which means a many things /great,sound,class,top,mint, you get my drift never known it to be mint meaning A1 as new ,if this would be the case to whom is reading these messages, should clearly be able to define my slang as I said SOME scrathes will come out or should I can;t remember , and is if used a word like SOME this should tell you that this item is not as new A1 ,, CORRECT ?
Dear justcallmespidey,
When you have an item for sale & you are asked the question "what condition is the item in" to answer with the word 'mint' gives this word only one meaning regardless of the slang you or anyone else uses, in a sale situation it means 'as new', 'A1' as you put it. I have already said that the item wasn't stated as just 'mint' & i also said that i wasn't expecting 'as new, A1' condition because you stated "some scratches" so yes CORRECT.
The fact still remains the bars where not as stated & i was overcharged on postage.
I suggest to resolve this matter there are 2 options, either a full refund of £59 & i return the bars, or a partial refund to reflect the condition of the bars & overcharged postage say £15-20 & i keep the bars & restore them at my own cost.
let me know what you would like to do.
Dear djgivvinup,
on your bike , refund for item only or leave my feedback , ok
What a lovely person he is :LolLolLolLol: :LolLolLolLol:
I've now opened a paypal dispute & im awaiting a reply from the nice man :2funny:

Sounds like a right fly boy :knuppel2:
Wait till after the 15th of May and leave him negative feedback as they won't be able to do it to you as thats when the new feedback system comes into effect :daumenhoch:

I contacted this chump thinking he would be cool about the issues i had, but noooo :LolLolLolLol:
I like the sound of the new feedback system, how does that work?
-
ebay should give u a full refund no prodlem.
just send them everything, all the responses and replys.
post the bars back now.
he will have a shock when they take the cash out of his account. :daumenhoch:
-
apparently the seller can't leave negative feedback for any buyer after the 15th :) something to do with retaliation feedback i think , after all , as a buyer you have done your part by paying on time so you should get positive feedback for it . I'll see if i can find the links for it through ebay so you can have a read :daumenhoch:

Superb!...Cheers for all the info Snav, much appreciated :daumenhoch:
heres my favourite part:
'Sellers will no longer be able to leave negative or neutral Feedback for buyers. This change will be introduced in May, 2008'.
So i guess my feedback won't be mirroring his :LolLolLolLol: :LolLolLolLol:

Sorry to hear about your experience with this Seller. Let us know how it goes.
I can't wait for this new feedback system to come in to force, the retaliation thing has definitely been a problem.
-
Justcallmesnidey. It would appear he's another spiv, giving us Geordies a bad name. He's not the only one :( I hope this new feedback ruling covers any transactions made before the 15th. I would check the small print just to make sure he can't try to stitch you up after you leave him the feedback he deserves.

I like the idea from ebay :daumenhoch:
He implies he is northern like myself, my description of mint would be mint condition ie: as new
wonder how he would feel if the item he bought wasnt as described...
-
If you've put in a dispute I don't think his feedback can effect your score.....the comments can be left but it won't be rated. Can anyone double confirm this?
-
we could just fook over all his future auctions until he sorts it.
-
jeez, another bad expierence on the bay...
i'm pretty sure even though you've opened a dispute with ebay the best you will get is the winning bid refunded and not the postage, doesn't seem right i know but it's happened to me in the past.
good luck anyway, hope you come out on top ;)
-
word of warning from experience - when you make a dispute with ebay they can do nothing about the money side of things (im £125 down because i didnt know this) they will take action against the seller but not financially. you need to ALSO open a dispute with paypal (presuming you paid that way) - they will immediately remove the money from his account and place it in limbo - if he doesnt have enough to cover the account they will put him with a negative amount.
hope this helps
Crooch

Yet another reason to avoid ebay and paypal like the plague.
-
Deffo do the paypal "item not as described" dispute thing too. Seller sounds like a right t0sser - best avoided in the future :daumenhoch:.
Changes to the Feedback stuff has pros and cons let's see how it pans out ;).
-
I put a bid in on these early on,then sent him a question, but the arrogant f00k told me to "look at the photos - they they tell all and dont lie"
Something didnt sit right,so i didnt bid again. Arse.
Hope your Paypal dispute sorts him out.At the very least the money will be held up once you go to a claim and then put his account into negative until its sorted
