I have one of these to put on my 09 Freestyler, how tight can I do this up on the forks without damaging them? If I do it too tight would it crush the tube?

Do it decently tight and add jubilee clips on both arms - the bugger will never move then :)

So don't do it too tight, just overnip it?

Do it up as tight as you'd fix a caliper brake onto forks, then secure the plate as the others have said. I used big fat zip ties on mine.
